Title Transfers

When you buy a vehicle, you need to transfer the vehicle’s title to establish yourself as the new legal owner.

Before you begin:

Have the California Certificate of Title with you. Make sure the title has been signed by the buyer(s), seller(s), and lienholder (if applicable).

If you do not have the title, complete an Application for Replacement or Transfer of Title (REG 227) .

Have the following:

Your driver’s license number
Vehicle license plate number
Vehicle identification number (VIN)
Legal owner (or lienholder) name and address
Vehicle make, model, and year
Purchase date and price

Be able to pay the transfer fee . All transfer fees are the responsibility of the buyer.

Allow 30 days from the day DMV receives your documents to process your title transfer.

An individual, co-owners, trust, or business may be established as the owner.

Any change of the current registered owner or lienholder (legal owner) of a vehicle or vessel/boat requires transferring the title to the new owner. Transfer of ownership between the seller and the buyer must be started with DMV within 10 days of the sale of the vehicle or boat. You will need:

Transfer fees . All transfer fees are the responsibility of the buyer.

Smog certification

Application for Replacement or Transfer of Title (REG 227) form.
A Vehicle/Vessel Transfer and Reassignment (REG 262) form.
A Statement of Facts (REG 256) form.
A Notice of Transfer and Release of Liability (REG 138) form.

HTVR 32 (REV. 6/2022)

A vehicle can be registered in the name of a trust as registered owners. The purchasers would enter the name of the trust as the new registered owner on the back of the title with one of the trustees signing for the trust. When the transfer of ownership is processed, it would be processed just like a vehicle being registered in a company’s name vs. an individual as owner.

A vehicle or vessel may be owned by two or more co-owners. Co-owner names may be joined by “and”, “and/or”, or “or”. Certificates issued for applications not indicating “and” or “or” between the names will show “and” as represented by a slash (/) between the names.

All owners must endorse the title or registration application to register the vehicle or boat, but the requirements for releasing ownership vary.

The signature of only one owner is required to transfer ownership when the co-owner names are joined by “and/or” or “or”.

The signatures of all owners are required to transfer ownership when the co-owner names are joined by “and”. Ownership passes to the surviving co-owner upon the death of a co-owner or, with the surviving co-owner’s release, to a new owner. A deceased co-owner’s interest may only be released by one of the following:

Heir of the deceased with an Affidavit for Transfer Without Probate California Titled Vehicle or Vessels Only (REG 5) form.
Administrator with Letters of Administration.
Executor with Letters Testamentary.

When the names are joined by the word “or,” one owner can sell the vehicle without the other’s signature. The word “and” or a slash (/) requires the signature of each owner to sell the vehicle.

Submit the following to DMV:

A California Certificate of Title or, if lost, an Application for Replacement or Transfer of Title (REG 227) form, signed for the decedent and countersigned by the heir. Example: John Jones by Mary S. Jones, sole heir, successor, administrator, executor, conservator, guardian, or trustee.
Affidavit for Transfer Without Probate California Titled Vehicle or Vessels Only (REG 5) form completed by the heir. A power of attorney (POA) cannot be used to sign a REG 5.
Court order, Letters Testamentary, Letters of Administration, Letters of Administration with Will Annexed, or Letters of Special Administration.
A REG 256 with the applicable sections completed.
An odometer disclosure statement for vehicles less than 10 years old completed on the California Certificate of Title or Vehicle/Vessel Transfer and Reassignment Form (REG 262) (not available online).
Fees for transfer of ownership and, if due, registration renewal and use tax.

Transfer Without Probate

In certain situations, the decedent’s heir may transfer title of a vehicle/vessel without going through probate. Requirements are:

Person(s) who succeeded to the property of the decedent.
Conservator or guardian of the property of the person(s) who succeeded to the property of the decedent.
Beneficiary under the decedent’s last will and testament.
Trustee(s), under a trust agreement by the deceased, in which the primary beneficiaries are the next of kin.
The value of the decedent’s property in California does not exceed $150,000. Does not include vehicles, vessels, commercial coaches, or manufactured, mobile, or floating homes. To calculate the property value, see California Probate Code §13050.
The vehicle/vessel is titled in California. Vehicles/vessels titled in another state must be transferred in that state (requirements may differ from California).
40 days have lapsed since the registered or legal owner’s date of death.
An original or certified copy of each owner’s death certificate and, if owned jointly by two or more decedent’s, a REG 5 for the most recent decedent
If owned jointly by two or more persons and one is deceased, a REG 5 cannot be used to circumvent the surviving owner’s interest. However, the surviving owner (if an heir) may complete a REG 5 to release the decedent’s interest. The title must be signed twice, once by the surviving owner and once on behalf of the decedent.

Trust Transfers

Establishment of a trust commits the property or assets of an individual(s) to a trustee for use or safekeeping.

A releasing signature for a trust cannot be made by power of attorney, unless the power of attorney document is restricted to a specific transaction.
If more than one trustee is shown without “or,” or a slash (/) between the names, each trustee must sign the title.
If the trustee signing is not shown on the title, a REG 256 (Section G) is required attesting to his/her appointment as successor trustee by the trustor or retiring trustee.
If a trustee releases interest of a vehicle/vessel not registered to a trust, ownership is determined by the decedent’s will as contained in the trust document. The trust document and REG 262 copies may be required.
If no trustee name is shown on the title, a REG 256 (Section G) is required attesting to his/her appointment as trustee or successor trustee by the trustor.

Transfer With Court Documents

The Certificate of Title must be signed for the decedent and countersigned by the executor or administrator.

Once the buyer has all the required documentation and DMV receives the completed Notice of Transfer and Release of Liability from the seller, the seller’s part of the sale is complete. Once the buyer provides DMV with all the proper documents and fees, and all the requirements are met (for example, smog certification), the vehicle record is updated to reflect the change of ownership (the seller’s name is removed) and a registration card is issued to the new owner. A new title is issued within 10-15 calendar days.

It’s easy to submit a Notice of Transfer and Release of Liability (NRL) online to let DMV know that you are no longer responsible for parking/traffic violations or civil or criminal actions associated with the vehicle after the date of sale.

There's been plenty of back and forth this week about Diane Abbott, who had the Labour whip restored yesterday.

Despite this, questions remain over whether she will be able to stand for the party - with Labour leader Sir Keir Starmer insisting she is not barred.

Speaking at a rally in her Hackney North and Stoke Newington constituency, she said: "By any means possible I will continue to stand as the candidate for Hackney North."

"I'm not going to allow myself to be intimidated or frightened by forces beyond all of our control," she added.

The rally was only organised last night when reports first emerged that she might be barred from standing.

Ms Abbott said she was "shocked" to hear the reports.

She didn't make clear during her speech at the rally whether she'd be prepared to run as an independent.

Former Labour Party leader Jeremy Corbyn has launched his campaign to be re-elected as the independent MP for Islington North tonight.

The candidate, who is independent after losing the party whip, said he is "disturbed" by the way Labour MP Diane Abbott "has been treated".

The party whip was restored to her yesterday, but she has claimed that she has been barred from standing for Labour in her Hackney North constituency.

Sir Keir Starmer denies this is the case.

Mr Corbyn told Sky News: "Whenever I read the feeds to her social media, my stomach churns with the abuse that she puts up.

"It's a threat she's suffered, the indignity that's been thrown at her. And she's come through it all so strong.

"The last rally she went to: fantastic.

"There were thousands of people there, particularly black women, who knew what it was like to suffer racism and weren't going to let it happen to Diane."

In a speech, Mr Corbyn promised to stand up for those "who aren't being served by our political system...who aren't being heard" and whose "demands fall on deaf ears".

The demands include an end to the occupation of Palestine, a fully public NHS, the abolition of the two-child benefit cap, public ownership of water and energy, and rent controls, according to his campaign.

"When I vote in parliament, I don't vote alone," Mr Corbyn concluded.

"I vote with my community - and our campaign will bring people of all ages, backgrounds and faiths together for a fairer society."

Rishi Sunak has been "a bad prime minister" since he took office two years ago, according to exclusive polling for Sky News.

The Great Britain poll - conducted on Monday and Tuesday this week by YouGov - put the Conservative Party 27 points behind Labour as the general election nears.

But the survey also showed discontent with the Conservative leader.

Sir Keir Starmer didn't fare much better, according to the statistics, with 47% saying he would be "a bad prime minister" if he won the vote on 4 July.

But in another blow for Mr Sunak, 19% of people who voted Conservative in 2019 said they would instead back Reform this time round, while 14% would go for Labour.

The polling also found 42% of the public felt worse off than they did six months ago, despite the prime minister and has team repeatedly saying the economy had "turned a corner".

And 14% of those asked said they felt better off.

Speaking in a Q&A earlier today, Mr Sunak said he was "not worried about the polls" after a stream of bad looking numbers for the Tories.

"The only poll that matters is the one on 4 July, when all of you get to choose our future, that's the one I am focused on," he said.

"And as you can see, I hope, I am working my socks off to talk to as many people as I can over the next five weeks."

Trebling taxes for search engine and social media firms could fund a mental health professional in every primary and secondary school, the Liberal Democrats have said.

Party leader Sir Ed Davey said children are "being left in limbo" when they seek mental health care.

The Lib Dems have unveiled plans to employ mental health professionals in schools if they make it into government, which they claim could be funded through an increase to the Digital Services Tax - currently 2% on search engine, social media and online market place companies' revenues.

Sir Ed said: "Thousands of children are being left in limbo, forced to suffer intolerably long waits for mental health treatment.

"They are being failed by this Conservative government who have neglected the NHS and abandoned parents and children.

Sir Keir Starmer was out and about in the West Midlands to promote his pledge to clear the backlog of patients waiting more than 18 weeks for NHS treatment within five years of government;
His shadow health secretary, Wes Streeting, told our political correspondent Tamara Cohen the NHS was "over-reliant" on overseas workers;
But their message on the health service has been completely smothered by a lack of clarity on whether the veteran MP Diane Abbott will be able to stand for Labour at the general election;

Rishi Sunak was in the South West of England promoting his promise to replace "rip-off degrees" with 100,000 apprenticeships each year by the end of the next parliament;
Mr Sunak has lots of work to do to make up ground against Labour - an exclusive Sky News / YouGov poll reveals the opposition is a whopping 27 points ahead;
But the PM insisted he was "not worried", telling a Q&A in Devon the only one that matters is on 4 July;
The Tories also accused Labour of "scrambling to distract" from Labour's Diane Abbott row, after the party claimed Conservative pledges will leave people worse off;

We're still very much in the early days of the election campaign - but policy announcements are coming in thick and fast from the main two parties.

Here's a breakdown of what we've heard so far...

The Conservative Party

National service - The Conservatives have vowed to bring back a "modern" form of national service for 18-year-olds in the UK, which could involve military service of volunteer work.

'Triple lock plus' - The party has promised to cut taxes for pensioners by creating a new "age-related" tax-free allowance - dubbed "triple lock plus". In short, a pensioner's allowance would rise in line with either average earnings, inflation or by 2.5% - whichever is higher - from next April.

Education - The Tories have promised to create a new qualification framework called the Advanced British Standard for those aged 16 to 18. The party also proposed making "some form" of maths and English compulsory up to the end of school.

Environment - Rishi Sunak has said he remains committed to plans to reach net zero by 2050, a goal adopted under Theresa May in 2019.

Apprenticeships - The prime minister wants to replace "rip-off" university degrees with 100,000 new apprentices a year, which he thinks will leave young people better off and with greater opportunities.

The Labour Party

Taxation - Labour has pledged not reverse the two recent cuts to national insurance - and not to increase income tax.

Economy - Two flagship economic pledges from Labour are the abolition of the non-dom tax status held by some wealthy foreign nationals, and the introduction of VAT to private school fees.

Waiting lists - The party has said it will get the NHS "back on its feet" by delivering 40,000 more evening and weekend appointments per week, helped by "crack teams" to help staff clinics at those times.

Environment - A major policy pushed by Labour is the formation of Great British Energy, which would be publicly owned. The party claims this would reduce household energy bills and create jobs.

Education - Also a headline policy from Labour is a plan to recruit around 6,500 new teachers in key subjects - and create a "national excellence programme" to support professional development.

Earlier today, Darren Jones, Labour's shadow chief secretary to the Treasury, accused the Tories of launching a "severe" threat to family finances with their campaign pledges so far.

He claimed that the policy proposals - such as national service and a "triple-lock plus" for pensioners - could cost as much as £350 a month to mortgage holders.

Responding to this, a Conservative Party spokesman claimed "their own promises would come to a staggering £196.4bn of unfunded annual borrowing" under the same analysis.

The Tories claim this is "whacking Brits with a 6.9% interest-rate rise".

The spokesman said: "Really this is pathetic, desperate stuff from the Labour Party as they scramble to distract from the fact it has been proven Keir Starmer lied on multiple occasions about the Diane Abbott investigation.

"Now the Labour leader is embroiled in a ‘he said, she said’ with the veteran Labour MP, sending their limp campaign into even more of a tailspin.

"Instead of sticking out shoddy documents with made-up figures, Keir Starmer needs to explain why he repeatedly lied about the status of the Diane Abbott investigation, and when he plans to apologise to the British people."

The Democratic Unionist Party has just launched its general election campaign, and with it ratified Gavin Robinson as the new leader.

This comes afters meeting of the party's ruling executive on Wednesday.

Mr Robinson has been serving as interim leader since early April, when Jeffrey Donaldson resigned from the DUP and was suspended from the party after being charged with historical sexual offences.

"It is with honour, humility and commitment that I look forward to leading our party into the future," the new leader said.

Port City Air: Without fanfare, Pease airport services provider boosts Seacoast economy

PORTSMOUTH — Ned Denney acknowledges most people “don’t have a clue” that 150 people work for Port City Air.

But Denney, the chief executive officer of Port City Air, says the company's facility is a "beehive of activity" every day and a key economic driver in Portsmouth and the Seacoast.

The fixed base operator, or FBO, is headquartered on Grafton Drive at Portsmouth International Airport at Pease. Founded 20 years ago, Port City Air services airlines and companies from all over the world, along with the U.S. Air Force and military, he said.

“Ninety-five percent of our customer base over the course of a year comes from elsewhere. Our customers are in Italy, our customers are in Germany, our customers are in San Francisco,” Denney said during a recent interview and tour of Port City Air’s facilities at Pease, which features five hangars.

A fixed-base operator is an entity that provides aeronautical services at an airport, including but not limited to fueling, according to Michael Mates, director of engineering for the Pease Development Authority, which oversees all operations at the Pease airport.

Full-service aviation company

Denney said Port City Air, known as PCA, is “a fixed based operator but we’re way more than that.”

“We’re really a full-service aviation ground-handling company,” he said during an interview at PCA’s headquarters last week. “And I would say 10 to 15% of our business is traditional FBO business.”

PCA has an “FAA designation for their full service maintenance department” with four different divisions that can handle repairs and maintenance of “any type of aircraft,” he said, including jets and helicopters.

“We specialize in anything that’s strange, weird, bulky,” Denney added.

Their hangars are home to as many as 70 different aircraft at one time, he said.

PCA has invested more than $20 million in equipment needed to handle the largest commercial and military aircraft seeking to land at the Portsmouth airport.

Only Allegiant Airlines flies commercial flights in and out of Portsmouth, which Denney called a “snoozefest” in terms of just commercial aviation.

But those Allegiant flights — which are processed by PCA staff on the ground — represent just a small portion of what the company does, he said.

“We are busy every single day and no one knows that, and that’s one of our problems. We just put our head down and do our job every day," he said.

Civil Reserve Air Fleet flights help keep PCA busy

While only Allegiant offers commercial flights out of Pease, Denney said, there are a number of high-profile — and lesser-known commercial airlines, too — that regularly fly in and out of Pease transporting military passengers and cargo.

“You want to ask about commercial airliners, we have United, Delta, Atlas, Polar, Kalitta, Breeze was here yesterday and JetBlue,” he said. “And then there’s airlines you’ve never even heard of, like National Airlines.”

All those airlines he mentioned transport military passengers and cargo into Portsmouth, often as a stop before they head overseas, Denney said, as part of the Civil Reserve Air Fleet (CRAF).

The airlines “contractually pledge aircraft to the various segments of CRAF, ready for activation when needed,” according to an Air Force webpage on the program.

“To provide incentives for civil carriers to commit aircraft to the CRAF program and to assure the United States of adequate airlift reserves, the government makes peacetime DOD (Department of Defense) airlift business available to civilian airlines that offer aircraft to the CRAF,” according to the website.

Denney explained, “Ten years ago almost 100 percent of all the CRAF program traffic went through Bangor, Maine.”

“Today 80% of that traffic goes through here,” he said. “That happens because of service, that happens because we forge personal relationships with the airline staff.”

PCA crew sells Portsmouth, leader says

He credited PCA staff with working to make military planners and schedulers aware CRAF flights could land here, and what Pease and Portsmouth have to offer.

He credited Stephanie Pratt, PCA’s director of sales and marketing, with helping to bring the CRAF flights to Portsmouth.

“What she has done with her group … is to get people aware of what we do here and how we do it,” Denney said.

She and other PCA employees also regularly book military crew at local hotels and send them to Portsmouth restaurants, Denney said.

“We do over 12,000 hotel rooms a year,” he said. “We have special meetings with the hotel people sometimes.”

He acknowledged that the city of Portsmouth and all it has to offer has helped attract the flights here.

When at first PCA had some trouble attracting CRAF flights to Portsmouth because passengers/crew needed as many as three meals, they developed their own catering company, Jamie McCarthy, PCA’s director of FBO operations, said.

“That included upscaling the commercial kitchen so we were able, by having that capability, to attract these CRAF flights,” he said.

McCarthy stressed the physical location that used to be home to the Pease Air Force Base “has been here forever” but it wasn’t developed.

It's grown to where it is now, he said, “because Port City Air put the investment and equipment and people into it to make it all happen.”

About 80% of PCA’s operations involve the military, Denney said.

That includes at times hosting flights from other countries' military aircraft, he said.

“We’ve had the Royal Air Force, the RAF, you’ll see the Swedish Air Force from last week,” Denney said as he shared a PCA flight schedule during the tour. “We have the Italian Air Force coming in this week.”

The reason PCA is able to attract the flights that they do, which gives them the opportunity to continue to grow, is “all about service,” Denney said.

“If you come here, you land, and we take care of all of your needs, hotel reservations, restaurant reservations,” he said. “We provide you with crew cars … we have about 30 crew cars, which we give out to people to go to the local hotels.”

Because of the airport’s 2-mile runway — and PCA’s investment in equipment — it can also attract cargo flights that other airports can’t handle, Denney said.

“One of our biggest customers is Antonov Airlines, which is one of the largest cargo operations in the world that’s based out of the Ukraine,” he said. “You can imagine how busy they’ve been.”

Mayor touts PCA's economic impact in Portsmouth

Portsmouth Mayor Deaglan McEachern said he knows “the folks over at Port City Air and I have toured their facility.”

“I’m impressed with the work they do in terms of their commitment to the United States armed forces,” McEachern said Wednesday.

He's proud of PCA's willingness and ability to work with the civilian flights carrying U.S. military.

He also believes Port City Air is a “big economic driver” to the Portsmouth and Seacoast communities.

“They engage the local community in a lot of ways, jobs is certainly one of the big aspects, but so is working with Allegiant on the flights down to Florida and the military flights they’re involved with,” McEachern said.

Many people might not notice all they bring to the community, he said, “but the whole economy works together in no small part because of the work Port City Air does, whether that’s sending people to our local hotels or downtown restaurants.”

Million Air application at Pease has stalled, would have been a competitor for PCA

Port City Air has opposed the effort by Million Air , which is also known as Pease Aviation Partners LLC, to open a competing fixed based operator off Exeter Street at Pease, because of environmental concerns about the site, attorney Jake Marvelley, who represents PCA, said Wednesday.

Seacoastonline reached out to Pease Development Authority officials on Wednesday for an update on the status of Million Air’s application, which appears to be stalled at this point.

Tiffany Eddy, the spokesperson for the PDA, said, “Pease Aviation Partners has not sought to move its site plan and subdivision application before the PDA Board of Directors acting as a Planning Board.

“At this point, deadlines for consideration of that application under the PDA land use control have expired,” she said. “As a result, there is no further action for PDA to take at this time.”

Will PDA become a fixed based operator?

During a May 2023 PDA Board of Directors meeting, Steve Duprey, the board chair, raised the prospect of whether the PDA should consider creating its own FBO at the airport.

Paul Brean, the PDA’s executive director, in response to a Seacoastonline inquiry, stated “the PDA Board has expressed a desire at its public board meetings to learn more about airport FBO models.”

“The PDA is fortunate to have an engaged and informed board that seeks to understand the various types of ground service programs at commercial airports,” Brean said Wednesday. “This review will allow the board to gain insight into operational, economic, and sustainable practices that will ultimately factor into future decision-making that prioritizes making the airport as self-sustaining as possible.”

Asked about the relationship between Port City Air and the PDA, Brean said in part that “daily, the PDA as the airport owner and operator, and Port City Air as an FBO, work together to manage commercial operations and the military transient programs at the airport.”

“For the flying public to be served appropriately, an airport owner/operator and an FBO should work in synergy,” he said in response to a Seacoastonline question. “Considering what we accomplish daily at Portsmouth International Airport, I would say that synergy has been successful.”
