This guide is aimed at law students selecting a research paper topic. You should aim to find a specific, original research issue that you find fascinating. The process for choosing a topic varies but might involve the following steps.

  • Reach out to potential faculty supervisors to discuss and refine the thesis statements you are considering.

Working Papers Repositories

After browsing current awareness services for ideas, hopefully you’re starting to have a few possible topics. Digging into working papers is a good next step. Working paper repositories host collections of scholarly articles not yet published or in final form. The benefit of searching in working paper repositories is to gain a sense of the current academic conversation on a topic.

  • SSRN (Social Science Research Network) SSRN is a working paper site used by most U.S. law professors. Accessing it through HOLLIS will allow you to set up an individual account and subscribe to email alerts.
  • Law Commons This open access working paper site is easy to browse by topic, author, and institutional affiliation.
  • NBER Working Papers The National Bureau of Economic Research hosts working papers related to finance, banking, and law and economics.
  • OSF Preprints Multidisciplinary repository more global in scope than those listed above.

Academic Literature

As you begin to settle on a topic, you'll want to explore the legal academic literature. If your topic is not solely legal in nature, but falls in other academic disciplines like economics, sociology, political science, etc. you'll want to use HOLLIS and Google Scholar as you explore and refine your topic.

  • Hein Online Law Journal Library (Harvard Key) Provides pdf format for law review articles in 3200 law journals. For most, coverage is from inception. Includes a good collection of non-U.S. journals.
  • Lexis+ Law Reviews and Journals (HLS Only)
  • Westlaw Law Reviews & Journals (HLS Only)
  • LegalTrac Topic Finder (HLS only) LegalTrac is an index (descriptions of articles) and has some full text. It is included here for its topic finder tool which allows you to put in some general topics, and then refine the terms to generate a list of linked articles.

Academic Articles, Books and Book Chapters

  • HOLLIS Catalog and Articles Beyond finding the books, ebooks, and journals owned by the Harvard Library system, using HOLLIS in its default mode (Catalog & Articles) allows you to find articles from many subscription sources. Before settling on a paper topic, running some searches in HOLLIS is a must.
  • Harvard Google Scholar Google Scholar limits results to scholarly research publications. Harvard Google Scholar will (usually) allow you to link through to content from Harvard-subscribed sources.

Dissertations, Theses and Papers

As you refine your topic ideas, it is often helpful to browse the titles of dissertations and papers by SJDs, LLMs, or JD students, either generally, or those which touch on your subject area. This can help you understand how people have framed their research topic in a discrete, specific way. 

  • Proquest Dissertations and Theses (Harvard Key) This database includes dissertations and theses from many academic institutions but has not included HLS SJD dissertations or LL.M. papers in recent years.
  • HLS Dissertations, Theses, and JD Papers The library holds HLS student papers in print format. This guide describes our collection and how to find them using HOLLIS.
  • Global ETD Search (Networked Digital Library of Theses and Dissertations) Global in scope. Collectively search academic repositories of theses and dissertations.

Tips on Finding a Faculty Advisor

HLS LL.M. papers require faculty supervision. Discussing your topic with a potential faculty supervisor can be an important step in solidifying your topic ideas. 

  • HLS Faculty Directory The directory can be searched or browsed by area of interest. Note that some professors are here for only part of the year. Faculty supervisors must have a teaching appointment in the semester in which the paper is to be turned in.
  • HLS Course Catalog This is the best source to determine who is currently teaching in your topic subject area.
  • HLS Faculty Bibliography This collective list of publications of the HLS faculty can be searched and limited by date.

Tips for Refining a Topic

As you’ve browsed blogs, news, law reviews and other LL.M. papers, you have hopefully arrived at some topic ideas that are original and will hold your continued interest as you write your paper. It is also important to refine your paper topic to a discrete, narrow idea. Picking a topic can be the hardest part of writing a substantial paper or journal note. A good topic will make a claim that is both novel and adds to the discussion in a particular area of law.

The first step in choosing a topic is identifying a legal problem. Among other forms, this problem may be a policy concern, a conflict in the law, a gap in knowledge, or an issue surrounding a new legal development.

The second step for choosing your topic is proposing a solution to the problem, which will be the basis of your argument or thesis.

After crafting your thesis, the third step is conducting a preemption check to ensure that your topic has not been preempted by other writing on the subject. This guide details sources for help in selecting a paper topic available through the Ross-Blakely Law Library, as well as freely available online, and offers insight in how to check whether your paper will add new information to the field of law.

Questions to consider in choosing a paper topic When choosing a topic, it may be helpful to consider what subjects, classes, or activities you already enjoy and whether an appropriate topic can be developed from them.

What classes do you enjoy most in law school? What law school organizations do you belong to and what projects were rewarding or useful? What projects from your summer legal employment were interesting? What news stories have you heard lately that troubled you? What areas of law would you like to practice in?

But a paper must also add novel information to its field. This article discusses the balancing act of finding something new in a legal field that has already drawn attention.

A Short & Happy Guide to Advanced Legal Research (Ann Walsh Long, 2022) (West Academic password required off campus) Chapter 7 of this brief volume goes into depth on the process of finding, planning, and writing an extended academic paper on the law similar to what professors produce. It recommends seeking expert guidance on a topic and identifies several fertile sources, including circuit splits, state surveys, and law review symposia. It also provides guidance on the preemption check that helps ensure your written product will be unique and valuable, as well as organizing research, editing, and building credibility with comprehensive footnotes crediting experts in the field.

A good way to generate a topic is to look at how different jurisdictions have treated a particular issue. To do this you can examine splits between the circuit courts, in which federal appellate courts from different jurisdictions have disagreed on an important federal question.

U.S. Law Week: Circuit Splits  (Bloomberg Law password required) U.S. Law Week is published weekly by Bloomberg Law.  It includes information on important cases handed down each week and current legal developments. It also has a monthly "Circuit Splits" Feature.

Resources that focus on the "hot topics" in law can be helpful in identifying issues that have not yet been clearly addressed by the courts or legislature and are ripe for academic commentary.

Bloomberg Law - In Focus Resources   (Bloomberg Law password required) Bloomberg Law's In Focus resources are editorially curated pages that provide access to news, commentary, litigation filings, regulatory developments, and practice tools on emerging issues and other topics of note to legal practitioners.

CRS Reports - "Congressional Court Watcher" The Congressional Research Service is a public policy research institute within the United States Congress, tasked with providing research and analysis on topics related to policymaking. From their website, search for "Congressional Court Watcher" to find weekly updates on appellate decisions that may be of interest to lawmakers.

Resources that track and analyze current events and developments in the legal world, such as blogs, may also provide topic ideas. 

ABA Journal Blawg Directory This comprehensive directory of continually updated law blogs allows browsing by topic, author type, region, and law school.

Justia Blawg Search Justia has a listing of over 6,000 law blogs which have been organized in to 75 categories.

Law Professor Blogs Network This is a centralized website for the network of law professor blogs, which are blogs devoted to particular legal subjects written by law professors.

SCOTUS Blog The Supreme Court of the United States Blog provides comprehensive coverage of the U.S. Supreme Court and a wide-ranging array of resources related to Supreme Court cases.

Current Awareness Services in Print

Some services providing analysis of current development in the field and reports of recently decided cases are available in print in the Law Library. Searching the catalog for these tools can be difficult at times. Consider using “reporter” and your legal topic as a keyword search. Other words that may prove useful include “weekly,” “alert,” “current,” “news,” “analysis,” or “newspaper” and then use one of these in conjunction with “law” or “legal.”

Practicing attorneys use current awareness tools to stay up-to-date with breaking news, statutory and regulatory changes and appellate court opinions in their field of practice. You should learn how to use these tools in law school.

Language and the Legal Discourse

The institution of law relies heavily on language as it serves as a medium for the enactment and execution of laws. The use of accessible language is a critical aspect of ensuring that the justice system is fair and accessible to all citizens, regardless of their language proficiency or background. In January this year, the Chief Justice of India, Justice DY Chandrachud, emphasised the comprehensibility of legal judgments in the Indian landscape. He remarked that English “is not comprehensible to 99.9% of the citizens… [And] access to justice cannot be meaningful unless citizens can understand a language, which they speak and comprehend.” In a country as linguistically diverse as India, the initiative of translating judgements into vernacular languages by the Supreme Court is particularly a commendable step towards ensuring meaningful accessibility to justice. In yet another laudable move, the CJI has announced that the Supreme Court will shortly release a glossary of inappropriate gendered terms used in legal discourse. This glossary aims to draw attention to the prejudice women encounter not just in the larger society and legal system but also in the language itself. Law school requires all JD students to write a substantial research paper at some point during their law school careers. For some students, this is a law review note. For others, it is a seminar paper or the result of an independent study. Do E-Cigarette Retail Licensure Laws Reduce Tobacco Use?

E-cigarette licensure laws (ELLs) require retailers to obtain a state license to sell e-cigarettes over the counter. This study is the first to comprehensively explore the effect of ELL adoption on youth and adult tobacco product use. Using data from the State Youth Risk Behavior Survey (YRBS) and a difference-in-differences approach, we find no evidence that ELL adoption reduces overall youth ENDS use. The precision of our estimates allows us to rule out, with 95 percent confidence, ELL-induced prior-month youth ENDS use declines of more than 3.4 percent. The pattern of null findings persists when we examine ELLs that impose (1) higher penalties for retailer non-compliance, (2) higher renewable licensure fees, and (3) criminal as compared to civil penalties. However, we do uncover evidence that adoption of ELLs with higher penalties associated with a modest reduction in ENDS use among Black teens. We conclude that ELLs have only limited success in curbing access to ENDS.

UCL LLM graduate, Dheemanth Vangimalla, wins an international research essay prize

UCL Laws LLM graduate, Dheemanth Vangimalla, wins the top award in the 4iP Council Research Awards 2023 for a paper based on his LLM research dissertation. Dheemanth will be speaking about his research topic at a webinar organised by 4iP Council, on 30th May.

We are delighted to announce that Dheemanth Vangimalla, a recent UCL Laws graduate of the LLM in Intellectual Property Law has received the top award in the prestigious 4iP Council Research Awards for 2023 for his paper entitled ‘Plausibility and the flotilla: have the English courts drifted from the commodore’s approach to the evidential requirement for patent validity, and if so, is this divergence justified?’

The 4iP Council Research Award is an international research competition for European University students studying at Masters and PhD levels. It seeks to promote new ideas on topics pertinent to the interplay between intellectual property rights and innovation. Submissions, based on a student’s Masters or PhD research, are assessed by 4iP Council’s Research Award Jury made up of intellectual property experts from academia, government and industry. The papers are evaluated based on criteria including:

  • Original thinking that broadens the debate on the chosen topic;
  • High quality written expression; and
  • Relevance to current IP problems and debate

and up to three prizes are awarded (winner and two runners-up).

In his winning paper, Dheemanth considered the origins of ‘plausibility’ and explored the evidential requirement that the term represents. His research revealed that there is divergence between the EPO and English courts in the evidential standard applied by the two decision-making bodies when assessing patent validity. He argues that the English courts adopting a higher standard lacks cogent justification as the standard neither reflects a balance between the competing objectives of the patent system nor limits a plausibility assessment to its targeted mischief. 

This paper was based on Dheemanth’s dissertation for his LLM in Intellectual Property Law, which was also recently awarded the IBIL Prize for Top Performance in an IP-related Research Essay on the LLM . During his LLM, Dheemanth was supervised by our IBIL scholarship PhD researcher, Joshua Bradley .

As part of the prize, the winning essay has been published on 4iP Council’s website , and Dheemanth will be speaking at a webinar about plausibility - orgainised by 4iP - along with IBIL's Professor Jacob, on 30 May. More details of the event can be found here . 

Having completed his LLM in the summer of 2023, Dheemanth has been working as a Research Assistant at the UCL Institute of Brand and Innovation Law  (IBIL), while also completing his bar exams. He will join Three New Square Chambers in the autumn as a pupil barrister.
