Better to call up the company or its RTA and ask for the exact procedure and documents requirement for change of name. They will guide you properly. If you fail to get in touch directly then you can send the letter to the company's address.

Excellent format, no need to call any body just use this format, company/RTA dare not reject it. After all, nobody wants to come in trouble under the eyes of SEBI, But be honest...period

How to Change Name on Physical Share Certificates

Need of change the name on physical share certificates:.

There are multiple reasons why people change their name. Major Examples are Due to Marriage, Astrological Believes, Due to Divorce etc. For the reason whatsoever, people change their name, it is recommended to update the new name on all the important documents such as PAN, Aadhar, Voter id, Passport, Shares and Securities, Insurance etc. Today we are writing about, “How to Change the name on Physical Share Certificates.

Recently SEBI Simplified the process to notify the name change on Securities held in Physical Form. According to SEBI, the move would help in simplifying the “procedure of change of name in individual Beneficial Owner’s (BO) account”. The depository participants (DPs) shall collect the self-attested copies of above documents and maintain the same in their records after verifying with the original document, the SEBI circular said.

The depositories are directed to implement the above provisions in three months. Further, depositories should have the system to keep the audit trail of the name change in the BO account similar to that of the address change or any other change of coordinates.

SEBI has also asked depositories to make amendments to the relevant “Bye-Laws, Business Rules and DP Operating instructions for the implementation of the above decision, as may be applicable or necessary”.

According to the regulator, the circular is being issued in the interests of investors in securities and to promote the development of securities market.

Change the name of Physical Share Certificates:

Any Shareholder who is desirous of Changing/Updating his/her name in the Share Certificates possessed by him/her will have to make application to the Company/RTA along with following documents:

1. Request Letter mentioning the reason for the name change.

2. Affidavit.

3. Attested copies of Marriage Certificate or Gazzate Notification.

4. Self Attested copy PAN Card duly notarized.

5. Self Attested copy Address Proof duly notarized. (E.g. Aadhar/Voter id/Driving Licence/Bank Statement etc.)

6. Original Share Certificate.

How to Obtain Gazzate Notification:

1. Prepare an Affidavit on Rs. 50/- Stamp Paper and get it Notarised by Local Notary Public of State mentioning the reason behind the name change.

2. Publish an ad for Change in Name in Two Newspaper, one English, and one Vernacular Language.

3. Visit Depart of Publication of your state with Self Attested Copy of PAN Card, Address Proof, and 2 Passport.

4. The Department will print the change of your name in the Gazette. The amount charged for Gazette notifications varies state to state. (Approx Rs. 1000/-)

Name Change Procedure on Physical Share Certificates: The Company/RTA may raise any queries or demand any other documents as per their policies.

In all of my physial share certificates alloted/bought in nineties my name was enterd with initials. My name on the share certificates was N CH NAGI REDDY or NAGI REDDY N CH, which was in vogue / practice at that time. Due to advent of PAN and AADHAAR the name is written in full as NANDYALA CHINNA NAGIREDYor CHINNA NAGI REDDY NANDYALA ( ie., N and CH/Ch for Nandyala and Chinna respectively. Now the RTAs asking for notorized Affidavits for change of names as per kyc and after submitting of ISR1,ISR2, ISR 4 as dematerialisation is not possible since the names are different. They are not willing to change the names , in spite of the circular by SEBI not to insist on Affidavits for small changes with abbreviation. Could you suggest me a draft froforma for such Affidavit to submit to RTAs.please. Nagi Reddy.

Not possible to delete any name in share certificate unless it is transmission . You will have to open Demat ac s as per names in share certificates . before that , you will have to complete your KYC process if you have not done so

There is mismatch in Fathers Name on share certificate. I went to Gazette office for name change but rejected on the ground that Son cannot apply for Gazette for name change of his father and father needs to apply it for his name change. Now, father is already passed away and cannot apply to it. So, son is also unable to apply and hence, Gazette is not getting done. I had a PAN Card having English signature. But later I changed it to Hindi because of regular complaints of signature mismatch. I also made small verification in my pan name. Now new PAN Card has Hindi sign and changed name issued under same pan number. But I had bought shares of xyz under my old pan details. Now I am not able to dematerialize my shares. What should I do now?

The Format of a Name Change Request Letter

Name change request letters should always be written in a formal format and should be attached with all the required documents that are needed as proof. Make sure you have a polite and respectful tone while writing the letter.

  • The letter starts with the ‘From’ address, which is your address.
  • The date should be mentioned on which the letter was written.
  • Next is the ‘To’ address, which is the address of the receiver.
  • The subject of the letter is “Name change request letter.”
  • Salutation is done, e.g. Dear Sir or Madam, Respected Sir/Ma’am.
  • Then the main body of the letter is written, which includes your old name and your new name, and a request to update it.
  • Thank you/Thank you in anticipation/Thank you in advance.
  • End the letter with “Yours faithfully, Yours sincerely.”
  • The signature of the person sending the letter and his name in block letters.
  • Proof documents have to be attached which include an affidavit duly signed by the applicant and attested by Judicial Magistrate and your updated photo id with your new name.

  • Both parents or guardians must approve that we can issue a passport to a child, and go with the child to apply in person.
  • If one or both parents or guardians cannot apply with their child, you will need to show us more documents.
  • You cannot renew your child's passport using Form DS-82.
  • Passports for children under age 16 are only valid for 5 years.

Tips to complete your child's form :

  • Do not sign your child's form until asked to do so by a passport acceptance agent or employee. 
  • You can apply for a passport book , a passport card , or both documents.
  • You may ask for a larger passport book with more visa pages, at no extra cost, by checking the 'large book' box at the top of the DS-11.

2. Get Evidence of U.S. Citizenship (and a photocopy)

Your evidence must be an original or replacement copy. The document must have the official seal or stamp of the office which issued it. You must submit one of the following documents for your child:

  • Issued by the city, county, or state of birth
  • Lists applicant's full name, date of birth, and place of birth
  • Lists the parent(s)' full names
  • Has the date filed with registrar's office (must be within one year of birth)
  • Has the registrar's signature
  • Has the seal or stamp of the city, county, or state which issued it
  • Consular Report of Birth Abroad or Certification of Birth
  • Certificate of Citizenship
  • Please note you must also provide a document, such as a birth certificate, that lists the parent(s) or legal guardian(s) of the child. Full validity means the document is or was valid for 10 years for adults and 5 years for children under 16.

Paper only : You cannot submit digital evidence of U.S. citizenship such as a mobile or electronic birth certificate. You must submit physical evidence of U.S. citizenship and a photocopy of the document. 

Returning your child's document : We will return your child's document in a separate mailing up to 8 weeks after you receive the new passport.

Tips for making a photocopy :

  • Black and white (no color)
  • Use 8.5 inch by 11 inch paper
  • Use a single side of the paper

If you do not submit a photocopy, you must submit a second copy of your citizenship evidence. We will keep this copy for our records.

3. Show Your Relationship to Your Child

You must submit a document that lists the parent(s) or legal guardian(s) of the child. Examples include:

  • U.S. birth certificate (also evidence of U.S. citizenship)
  • Foreign birth certificate
  • Adoption decree
  • Divorce or custody decree
  • A court order

Some documents, like a U.S. birth certificate, show  both  U.S. citizenship and parental relationship. These documents must be originals or certified copies (not photocopies).

You and your child may have different last names, as long as the document showing your relationship to your child lists your full name.

If your name is different than the one on the document showing your relationship to your child, submit proof of your legal name change.

4. Get a Photo ID (and a photocopy)

Both parents or guardians must bring a physical, photo ID and a photocopy of it. If your photo ID is from a different state than the state in which you are applying, bring a second photo ID. 

You must show at least  one  of these photo IDs:

  • Valid or expired, undamaged U.S. passport book or passport card 
  • In-state, fully valid driver's license or enhanced driver's license with photo
  • Certificate of Naturalization 
  • Certificate of Citizenship 
  • Government employee ID (city, county, state, or federal)
  • U.S. military or military dependent ID
  • Current (valid) foreign passport
  • Matricula Consular (Mexican Consular ID) used by a parent of a U.S. citizen child applicant
  • U.S. Permanent Resident Card (Green Card) used by a parent of a U.S. citizen child applicant
  • Trusted Traveler IDs (including valid Global Entry, FAST, SENTRI, and NEXUS cards)
  • Enhanced Tribal Cards and Native American tribal photo IDs
  • In-state, fully-valid learner's permit with photo
  • In-state, fully-valid non-driver ID with photo
  • Temporary driver's license with photo

5. Show More Documents (if both parents or guardians cannot apply)

  • Both parents or guardians must approve that we can issue a passport to a child, and go with the child to apply in person.
  • If one or both parents or guardians cannot apply in person with their child, you will need to show more documents.

6. Provide a Photo

You must provide one photo with your child's application. Go to our  Passport Photo page  for photo requirements and to see examples of photos. 

  • Do not attach or staple your child's photo to the form. The acceptance agent or passport employee will review the photo and staple it to your form.

  • Home. Ask your friend or family member to take your child's photo. Print it on glossy or matte photo quality paper. 

7. Calculate Fees

When applying using Form DS-11, you will pay two separate fees - an application fee and an execution (acceptance) fee. You will pay the application fee to the U.S. Department of State, and the execution (acceptance) fee to the facility which takes your application. 

  • Add $60 to your application fee if you want  expedited service .
  • Add $19.53 to your application fee if you want us to ship your completed passport in 1-2 days after we issue it.

8. Find Location to Apply

In the United States:

  • Traveling in more than 3 weeks?  Go to a  passport acceptance facility  such as a post office, library, or local government office. Check with the facility to see if you need to make an appointment. 
  • Traveling in less than 3 weeks?   Make an appointment  to apply at a passport agency or center.

In another country:

  • Contact your  U.S. embassy or consulate .

It may take 2 weeks from the day you apply until your child's application status is “In Process.”

You will get multiple mailings. The number of mailings depends on what document(s) you asked for.

Passport Book : You may get your new passport and citizenship documents in two mailings. You may wait 8 weeks after getting your passport before you get a second mailing with your citizenship documents. We will return the passport book using a trackable delivery service.

Passport Card : You may get your new passport card and your citizenship documents in two mailings. You may wait 8 weeks after getting your passport before you get a second mailing with your citizenship documents. We only send the passport card via First Class Mail. We do not send cards using 1-2 day delivery services.

Both a Passport Book and Card : You may get three separate mailings:

  • New passport book
  • New passport card
  • Citizenship documents

Contacting Us : If you have been waiting more than 8 weeks for your documents, call us at  1-877-487-2778  to report that you have not received your documents. 

If you want us to reimburse you for a lost supporting document, you must contact us within 90 days of the date which we mailed your passport. You will also need to provide a receipt to show the cost of replacing the document. 

Can I pay for faster delivery and return shipping?

Yes. You may choose one or both of the following shipment options:

  • Delivering application to us : Pay for Priority Mail Express for faster shipping. The price for this service varies depending on the area of the country.
  • Returning the passport to you : Pay $19.53 for 1-2 day delivery. This means you will receive your passport   1-2 days after we send it. Include this fee with your check or money order payable to the U.S. Department of State. Do not submit a return envelope to us with postage pre-paid. 

You may receive your passport and supporting documents in separate mailings. If you are renewing a passport card, we will send it to you via First Class Mail. We do not use 1-2 day delivery services if you only applied for a passport card.

What countries require Form DS-3053 "Statement of Consent" to be notarized at an embassy or consulate?

In this article, we are sharing the process of Name Mismatch In Share Certificates. Share certificates are the physical certificates issued to you when you take shares in a company. Sometimes,there could be a name mismatch in your share certificates and you may need to change it. This is done through a long process that involves government and immense paperwork.

Changing a name mismatch in share certificates is a very tedious task as it requires a lot of documentation, paperwork and notarised witnesses to actually get a new name.

There could be several reasons for a name mismatch in your share certificates.If the authorities are not cautious about using the same name which is in your documents or a demat account, a name mismatch may happen.

A name mismatch in share certificates is a very common happening and changing it is a lengthy and legal process.

There could be various reasons for changing names in your physical share certificates. Here are the reasons of change of name:

Documents Required For Correct Name Mismatch In Share Certificate

Any shareholder who has a name mismatch in his share certificates and wants to change it should file an application with the company along with the following documents-

  • Request letter mentioning the reasons for name change 
  • PAN card copies which are self attested and duly notarised (Aadhar card, bank statement, voter id, driving license etc ) 
  • Address proof , self attested and duly notarised
  • Original share certificate
  • Copies of marriage certificate 
  • Copy of gazette publication

Note: Since this entire process takes place online, it is important to submit all documents in JPEG format

Who Are Eligible To Apply For A Name Change in Share Certificate?

The individual must be the rightful owner of the shares in the company as stated in the share certificate.

  • Valid reason 

There should be a legitimate reason as to why the person is changing his/her name. It could be marriage, divorce or child adoption etc.

  • Complete documents 

Changing name in case of a name mismatch in share certificates is a highly legal process and hence you should have all the required documents duly notarised and self attested.

  • Payment of fees

You must pay stamp duty and gazette notification charges in accordance with the Indian stamp act and other relevant regulations.

  • Verification

The identity of ownership of shares and accuracy in information supplied in the application form must be demonstrated adequately.

Who Can Apply For Name Change in Share Certificate?

In case you have a demat account and a physical share certificate and there is a name mismatch in the two, you are likely to get it changed. However, following people can apply for a name change –

Shareholders

To get a name changed in your share certificate you have to be the rightful owner of the shares. It is also necessary to have a share certificate in your name before you can change your name.

Power of attorney holders

Power of attorney holders can apply on behalf of shareholders who are unable to apply themselves.

Legal Representative

When a shareholder dies, a legal representative, such as a will executor or estate administrator, can seek to change the name.

What To Do If You Have A Name Mismatch In The Share Certificate And Demat Account ?

The name on the demat account should be the same as the one on the share certificate.

It might happen that the name on the physical share certificate and the one of the demat account do not match. In this case , you can do the following-

Obtain a gazette letter or affidavit on government stamp paper stating that the name on the share certificate and the demat account belong to the same person.

With this letter, you can also submit the above mentioned documents and a request letter stating a legitimate reason for name change.

NOTE: You must provide notarised copies of gazetted letters or affidavits for all companies in which you hold shares.

How To Get A Gazette Notification ?

  • Prepare an affidavit on a stamp paper which costs Rs. 50/- and get it notarised by local notary Public of State and mention a reason for name change.
  • Publish this affidavit in ads in two newspapers, one in english and other in the vernacular language.
  • After this, go to the Department of Publication of your state and submit this along with the self attested copies of PAN card, address proof and 2 passports.
  • The department of publication will publish this in their gazette and charge some amount for the gazette notification which varies state to state and is approximately Rs. 1000/-

Note: The company may ask you for other documents or raise some query as per their policies.

Note: An NRI must register for a name change in the Indian embassy or Indian High Commission.

How To Apply For A Name Change In The Share Certificate ?

The 4- Step Guide To Change Name –

Prepare an affidavit

The first and foremost step when you have a name mismatch in your share certificate is to make an affidavit and get it issued by your local notary.

Notaries are responsible for stating the value of stamp paper used in affidavits.

If you want to change your name, the affidavit should include both your old and new names, along with a legitimate reason for the change. 

Besides this, it is important that an affidavit has the following applicant’s details-

  • Husband’s name 
  • Father’s name 
  • House address
  • Age proof etc

Publishing in a newspaper

Once you have made the affidavit, now you have to publish it in a newspaper. Now , you have to publish the news of your name change in the newspaper. Generally, there are special sections in the newspaper devoted to the same.

The publication has to be done in two newspapers, one in regional/ vernacular language and the other one in english. Important details to include in a newspaper publication –

  • New name of the applicant 
  • Old name of the applicant 
  • Full address
  • Age of the applicant 
  • Notary name who attested the affidavit 
  • Father’s /husband’s name

Publishing about the name change in official gazette of India

Once, you have published it in a newspaper, now you have to publish it in the official gazette of India along with an application, demand draft of fee and required documents.

In order to change the name of the company, the following documents must be submitted to the Department of Publication:

  • Affidavit for name change , notarised and self attested.
  • If you are a NRI, then present your required documents to Indian High Commission or Indian Embassy
  • Photocopy of the newspaper publication
  • Photocopy of application submitted for name change which must be duly filled in the appropriate format.
  • A digital CD, specimen in soft copy
  • Government employees are required to change their names in accordance with the Ministry of Home Affairs
  • Two passport size photographs
  • Enclosed in an envelope are the application and all supporting documents
